Miami congressman, Carlos Curbelo, willl present a bill that would ban Cubans who make use of the Cuban Adjustment Act to return to Cuba until becomoe US citizens.
The law if passed would alter the Cuban Adjustment Act currently grants permanent residency to Cubans who touch US soil without any travel restrictions.
“We are aware of the abuses of the Cuban Adjustment Act and we are trying to ensure that only those who suffer oppression in Cuba can benefit from the law,” said Carlos Curbelo, son of Cuban exiles.
“Those who return to the island would face consequences: quite likely the loss of his legal status in the United States,” continued Carlos Curbelo.
The construction bill provides that Cubans upon arrival to sign a formal declaration of fleeing the country due to political persecution. Once in the US, Cubans who signed that statement impact would face if returned to Cuba. Trip exceptions for emergencies would be allowed although those details, too, are not yet resolved.
Most Cubans who reach US either rafting or the US border with Mexico or Canada receive permission to stay in the country for their refugee status, the law allows them to obtain permanent residence a year and day and many return to the island where they said they were persecuted without any consequences.
The restoration of relations between Cuba and the United States could accelerate to tighten the Cuban Adjustment Act.

PROYECTO DE LEY IMPEDIRÍA A CUBANOS REGRESAR A CUBA EN 5 AÑOS.
El congresista de Miami, Carlos Curbelo, presentara un proyecto de ley que prohibiría a los cubanos que se acojan a la ley de ajuste cubano de regresar a Cuba hasta que se conviertan ciudadanos de Estados Unidos.
La ley de ser aprobada alteraría la ley de ajuste cubano que actualmente otorga la residencia permanente a los cubanos que tocan territorio estadounidense sin ninguna restricción de viaje.
“Somos conscientes de los abusos de la Ley de Ajuste Cubano y estamos tratando de asegurar que sólo los que sufren opresión en Cuba puede beneficiarse de la ley” dijo Carlos Curbelo, hijo de exiliados cubanos.
“Aquellos que regresan a la isla se enfrentarían consecuencias: bastante probable la pérdida de su condición legal en Estados Unidos” continuo Carlos Curbelo.
El proyecto de ley en construcción prevé que los cubanos a su llegada firmen una declaración formal de que están huyendo del país debido a la persecución política. Una vez en los EE.UU., los cubanos que firmaron esa declaración se enfrentarían repercusiones si regresaban a Cuba. Excepciones viaje para emergencias se les permitiría aunque esos detalles, también, aún no están resueltos.
La mayoría de los cubanos que llegan a Estados Unidos ya sea en balsa o por la frontera de Estados Unidos con México o Canadá reciben permiso para permanecer en el país por su estado de refugiados, la ley les permite obtener la residencia permanente al año y un día y muchos regresan a la isla de donde dijeron que eran perseguidos sin ninguna consecuencia.
El restablecimiento de las relaciones entre Cuba y Estados Unidos podría acelerar el proceso de hacer más estricta la ley de ajuste cubano.
