La ley exige que el Ejecutivo comunique con al menos 60 días de antelación la terminación del TPS para no quedar de manera irregular en el país. La secretaria de Seguridad Nacional anunció que no extenderá la protección concedida por el Gobierno de Joe Biden a cerca de 250.000 venezolanos.
LOS ANGELES- El Departamento de Seguridad Nacional (DHS) precisó este viernes que la designación del Estatus de Protección Temporal (TPS) de 2021 finalizará el próximo 7 de noviembre y pidió a los beneficiados “prepararse” para retornar a su país si no tienen otra base legal para permanecer en Estados Unidos.
Con esta decisión, unos 267.000 venezolanos, cuyo amparo vencía inicialmente el 10 de septiembre, ganaron un pequeño respiro gracias al plazo adicional fijado por la normativa, porque la ley exige que el Ejecutivo comunique con al menos 60 días de antelación la terminación del TPS, a fin de que los beneficiados tengan opciones para no quedar de manera irregular en el país.
“Si usted es extranjero y actualmente es beneficiario del TPS para Venezuela bajo la designación de 2021, debe prepararse para regresar a Venezuela si no tiene otra base legal para permanecer en Estados Unidos”, resaltó este viernes en un comunicado el Servicio de Inmigración y Ciudadanía (USCIS, en inglés).
El Gobierno estadounidense invitó a los venezolanos afectados con la terminación del beneficio migratorio a usar la aplicación CBP Home si pretenden salir de Estados Unidos.
La esperanza de quedarse de los inmigrantes está en manos de un juez federal de California que evalúa una demanda presentada por un grupo de venezolanos afectados y la Alianza TPS, en la que alegan que la terminación del amparo por parte del Gobierno del presidente Donald Trump es ilegal.
La querella legal busca proteger a dos grupos de venezolanos amparados por el TPS otorgado por el expresidente Joe Biden, los de 2021, unos 250.000, y los beneficiarios de la extensión de 2023, unos 350.000.

LOS ANGELES—The Department of Homeland Security (DHS) stated this Friday that the 2021 Temporary Protected Status (TPS) designation will end on November 7 and asked beneficiaries to “prepare” to return to their country if they have no other legal basis to remain in the United States.
With this decision, some 267,000 Venezuelans, whose TPS status was initially scheduled to expire on September 10, gained a small reprieve thanks to the additional period established by the regulations. The law requires the Executive branch to notify the beneficiaries at least 60 days in advance of the termination of TPS, so that beneficiaries have options to avoid irregularly remaining in the country.
“If you are a foreign national and are currently a beneficiary of TPS for Venezuela under the 2021 designation, you should prepare to return to Venezuela if you have no other legal basis to remain in the United States,” the U.S. Citizenship and Immigration Services (USCIS) emphasized in a statement this Friday.
The U.S. government invited Venezuelans affected by the termination of their immigration status to use the CBP Home app if they intend to leave the United States.
The immigrants’ hope of staying is in the hands of a federal judge in California, who is reviewing a lawsuit filed by a group of affected Venezuelans and the TPS Alliance, alleging that the Trump administration’s termination of TPS is illegal.
The legal complaint seeks to protect two groups of Venezuelans protected by TPS granted by former President Joe Biden: those granted TPS in 2021, approximately 250,000, and those granted TPS extension in 2023, approximately 350,000.
