A PUBLIC TRIAL IN A QUIET TOWN (THE TRIAL OF ANGEL CARROMERO IN CUBA)

The Consul of Spain in Cuba, Tomas Rodriguez, described the trial against fellow Angel Carromero as “clean, open and procedurally flawless”, ensuring that the defendant received a fair deal and that “the defense has been very good.”

When I heard this synthesis foreign journalists breathe easy because if we had touched make us accuse us of pro-Castro. Rodriguez, however, represents a politically right-wing government faced Havana.

The truth is that in the courtroom the defendant was accompanied by the Consul of the country and a lawyer sent from Spain by his family to advise the legal Cuban-agree with the diplomatic-led case skillfully.

In another room we were journalists. We were forbidden to enter recorders, laptops, cameras and phones but instead allowed us to monitor the entire trial live on a TV monitor while graphics colleagues hoped to achieve an image in front of the court.

According to my recollection did not have such facilities from the trial of Salvadorans to bomb tourist hotels, in the late 90s.

Hopefully this change will become policy for trials truly public.

The first impression on seeing all dressed in heavy black robes was to have entered a Harry Potter film but soon we found that both judges and the prosecutor and defense attorney were very thorough in their work.

The prosecution endeavored to prove that the accident was Carromero Angel responsibility for his temerity, impudence and lack of ability to lead. He leaned against all types of expertise, including a biologist who determined the hardness of the tree against which collided.

With the move to clear the room presented to a coroner who described and showed photos of the state as was the dissident leader Oswaldo Paya: skull divided into five parts, nearly decapitated, the pierced heart and kidneys become “mush” .

Defense attorney seemed only interested in the bad state of the road, the location of the warning signs and the certainty of the expert evidence. In the press room impatient sighs were heard each time he returned to examine the experts on these points.

Finally showed all their cards when based on those interrogations could reject part of the analyzes, revealing that things could have happened very differently and accountable to poor road sign by the disaster.

I do not know what effect it will have had between judges but journalists managed sembrarnos doubt and then we realized that this had been their strategy from the beginning. I wrote down his name, if I ever need a lawyer in Cuba I wish it was her.

He requested the acquittal of his client but from the beginning mentioned the possibility of a reduction in the tax application of 7-year sentence for a term of house arrest to meet in the house of the consul of Spain in Havana.

The next day Oswaldo Paya’s widow had told foreign media on the scene suggesting the thesis of the plot to murder her husband. “I do not know if you ever know the exact truth of things”, said by the tree that killed him.

Initially opposed and family handled the claim that the car was pushed off the road by another vehicle. However, he denied himself Carromero ensuring that at the time of the incident only saw a tractor coming the other way and over 200 meters.

The widow and children were taken to Bayamo in a vehicle that apparently belongs to the Catholic Church. It is a paradox because, before his death, Oswaldo Paya ally denounced the clergy for the government to marginalize dissent.

The presence of family Payá was the only political note of judgment. The prosecution did not use the confession and Swedish Modig Carromero where recognize who traveled to Cuba to deliver money and advise dissent in creating opposition youth groups.

Trial are few memories to bayameses, perhaps the most neighbors were aware of the court because local authorities were repaired and painted the facades of their houses to give a better picture of the city to foreign journalists.

On the morning of the next day, the city of Bayamo continued his usual pace car and bike riding. People walking along the boulevard and the only agglomeration occurred in Saco Street store where they were selling bathroom slippers.

UN JUICIO PUBLICO EN UNA CIUDAD TRANQUILA (EL JUICIO DE ANGEL CARROMERO EN CUBA)

El cónsul de España en Cuba, Tomas Rodríguez, describió el juicio contra su compatriota Ángel Carromero como “limpio, abierto y procesalmente impecable”, asegurando que el acusado recibió un buen trato y que “la defensa ha estado muy bien”.
Cuando lo periodistas extranjeros oímos esta síntesis respiramos tranquilos porque si nos hubiera tocado hacerla a nosotros nos acusarían de procastristas. Rodríguez, en cambio, representa a un gobierno de derecha políticamente enfrentado a La Habana.

Lo cierto es que dentro de la sala el acusado estuvo acompañado del Cónsul de su país y de un abogado enviado desde España por su familia para asesorar a la letrada cubana que -coincido con el diplomático- llevó el caso con mucha habilidad.

En otra sala estábamos los periodistas. Nos prohibieron entrar grabadoras, laptop, cámaras y teléfonos pero en cambio nos permitieron seguir todo el juicio en directo por un monitor de TV, mientras nuestros colegas gráficos esperaban lograr una imagen en la puerta del tribunal.

Según mis recuerdos no teníamos semejantes facilidades desde el proceso contra los salvadoreños que colocaron bombas en hoteles turísticos, a finales de los años 90.

Ojalá que este cambio se convierta en política para que los juicios sean verdaderamente públicos.

La primera impresión al ver a todos vestidos con pesadas togas negras fue la de haber entrado en una película de Harry Potter pero pronto pudimos comprobar que tanto los jueces como la fiscal y la abogada defensora eran muy rigurosos en su trabajo.

La fiscalía se empeñó de demostrar que el accidente fue responsabilidad de Ángel Carromero por su temeridad, imprudencia y falta de habilidad al conducir. Se apoyó en todo tipo de peritaje, incluso el de un biólogo que determinó la dureza del árbol contra el cual chocaron.

Con el evidente fin de conmover a la sala presentó a un médico forense que describió y mostró fotos del estado en que quedó el líder disidente Oswaldo Payá: cráneo dividido en cinco partes, casi decapitado, el corazón atravesado y los riñones convertidos en “papilla”.

La abogada defensora parecía solo interesada en el mal estado de la carretera, la ubicación de las señales de advertencia y la certeza de las pruebas periciales. En la sala de prensa se oían suspiros impacientes cada vez que volvía a interrogar a los peritos sobre estos puntos.

Finalmente mostró todas sus cartas cuando en base a esos interrogatorios pudo desestimar parte de los peritajes, dejando ver que las cosas podrían haber ocurrido de forma muy diferente y responsabilizando a la mala señalización de la carretera por la catástrofe.

No sé qué efecto habrá tenido entre los jueces pero a los periodistas logró sembrarnos la duda y entonces comprendimos que esa había sido su estrategia desde el principio. Yo apunté su nombre, si algún día necesito un abogado en Cuba me gustaría que fuera ella.

Finalmente pidió la absolución de su cliente pero desde el principio mencionó la posibilidad de una reducción de la solicitud fiscal de 7 años de condena por una pena de prisión domiciliaria a cumplir en la casa del cónsul de España en La Habana.

Al día siguiente la viuda de Oswaldo Payá hacía declaraciones a la prensa extranjera en el lugar del accidente insinuando la tesis del complot para el asesinato de su esposo. “No sé si algún día sabré exactamente la verdad de las cosas”, decía junto al árbol que lo mató.

Inicialmente la oposición y la familia manejaron la tesis de que el automóvil fue empujado fuera de la carretera por otro vehículo. Sin embargo, el propio Carromero lo desmintió asegurando que en el momento del siniestro solo vio venir un tractor en sentido contrario y a más de 200 mts.

La viuda y los hijos fueron trasladados hasta Bayamo en un vehículo que, aparentemente, pertenece a la Iglesia Católica. Resulta una paradoja dado que, antes de su muerte, Oswaldo Payá denunció al clero por aliarse al gobierno para marginar a la disidencia.

La presencia de la familia Payá fue la única nota política del juicio. La fiscalía no utilizó la confesión de Carromero y el sueco Modig, donde reconocen que viajaron a Cuba para entregar dinero y asesorar a la disidencia en la creación de grupos juveniles de oposición.

Del juicio pocos recuerdos quedan a los bayameses, tal vez los más enterados hayan sido los vecinos del tribunal porque las autoridades locales les repararon y pintaron las fachadas de sus viviendas para dar una mejor imagen de la ciudad a los periodistas extranjeros.

En la mañana del siguiente día, la ciudad de Bayamo continuaba con su ritmo habitual de coches de caballo y bicicletas. La gente caminaba por el boulevard y la única aglomeración se produjo en una tienda de la calle Saco donde estaban vendiendo chancletas de baño.
